Terms of Service

These Terms of Service govern your use of WebCD ("we," "us," or "our") and the services we provide at webcd.io. By creating an account, you agree to these terms.

1. What WebCD Is

WebCD is a platform for artists to create and distribute interactive digital albums, accept fan payments, and issue physical NFC cards tied to their music. Fans can listen to and collect artist WebCDs.

2. Your Account

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must be at least 18 years old to use WebCD.

3. Content

You retain ownership of all music, artwork, and other content you upload to WebCD. By uploading content, you grant WebCD a limited license to host, display, and distribute that content to fans through the platform.

You are solely responsible for ensuring you have the rights to all content you upload. You may not upload content that infringes on the intellectual property rights of others.

4. Payments and Platform Fee

WebCD enables fan payments directly to artists via Stripe Connect. Artists must connect a Stripe account to accept payments. WebCD charges a 10% platform fee on all transactions processed through the platform, including signatures and fan donations. The remaining amount is transferred to the artist's Stripe account.

All payments are processed by Stripe and subject to Stripe's terms. WebCD does not store payment card information.

5. Pro Subscription

WebCD offers a Pro plan at $9/month which unlocks additional features including increased album limits, analytics, and NFC card locking. Subscriptions are billed monthly and can be cancelled at any time. Cancellation takes effect at the end of the current billing period. Refunds are not issued for partial billing periods.

6. NFC Cards

Artists may generate NFC card URLs and program them onto physical NFC chips. These cards allow fans to link the card to their account and access card-exclusive content. WebCD is not responsible for the manufacture, shipping, or physical condition of any NFC cards produced by artists.

7. Prohibited Use

You may not use WebCD to upload or distribute content that is unlawful, infringing, defamatory, or harmful. You may not attempt to circumvent any platform security measures, abuse the payment system, or use the platform to defraud artists or fans.

8. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time from your account settings. Upon termination, your content will be removed from the platform.

9. Disclaimers

WebCD is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability of the service. We are not responsible for the content uploaded by artists or for disputes between artists and fans.

10. Limitation of Liability

To the extent permitted by law, WebCD's liability to you for any claim arising out of your use of the platform is limited to the amount you paid to WebCD in the three months preceding the claim.

11. Changes

We may update these terms from time to time. We'll notify you of material changes by email or by posting a notice on the platform. Continued use of WebCD after changes take effect constitutes acceptance of the updated terms.
